Civil Protection Order Representation

What Can A Lawyer Do For You?

As discussed above, permanent protection orders have very serious consequences.  It is important to have an experienced lawyer on your side representing your interests and your future.

Although restraining orders are very important to protect a person that has been assaulted, and that without a restraining order the harm will continue, in many temporary restraining orders the facts or harms alleged are exaggerated and even false.  It is important for the judge or magistrate to hear the facts of your side of the case before determining if a permanent protection order should be issued.
Often, people that represent themselves are not skilled in the law, statute interpretation, rules of evidence, rules of court room procedure, or even what is important to the particular magistrate or judge.  Although the court does provide some latitude to pro se parties, it is important to understand the questions need to be asked in proper form through direct examination and cross examination.  Also, if physical evidence (pictures, documents, recordings) is to be entered in court a proper foundation needs to be laid prior to admitting the evidence.
Also, an attorney that has a full understanding of the law may be able to work with the court and the parties to reach a resolution that does not have the negative consequences like the potential for loss of employment and other important rights discussed under the consequences of a restraining order section.  Often, there may be other methods to resolve the issue aside from a contested hearing.  This could be in the form of a mediating, a no contact order, a conditional dismissal, straight dismissal or extending the hearing with a continuance to give the parties additional time to work out the above resolutions.
Whether a person is the petitioner or the respondent, plaintiff or defendant, it is advantageous to have an attorney in your corner that has a complete understanding of the laws in the state of Colorado regarding protective orders.
