Property Division in a Colorado Divorce

The State of Colorado is an equitable distribution state, which means all of the marital assets in a divorce may not result in an equal 50-50 split. Property will be divided by the court in a manner that is deemed fair, but not necessarily equal. According to the Colorado Revised Statutes § 14-10-113, the Colorado Court will consider a variety of factors when determining a fair division, including:

  • Each spouse’s contribution to the acquisition of the marital property, including the contribution of a spouse as homemaker
  • The value of the property set aside to each spouse
  • The economic circumstances of each spouse at the time the division of property, including the desirability of awarding the family home to the spouse with whom any children reside the majority of the time
  • Increases or decreases in the value of the separate property during the marriage or depletion of the separate property for marital purposes
